These General Terms and Conditions govern the application and participation of exhibitors at WineOS 12. By submitting an application, the exhibitor confirms that they are familiar with these terms and conditions, and by making payment pursuant to the offer, unconditionally accepts participation and undertakes to comply with these terms and conditions, the offer and any subsequent organisational instructions issued by the Organiser.
1. Organiser and Scope of Application
The organiser of the fair is the Dekanter Association, J. J. Strossmayera 21, 31000 Osijek, OIB 60202199612 (hereinafter: the Organiser). For communication, the following email address is available: izlagaci@wineos.biz. These terms and conditions form an integral part of the application and the offer for participation. If any provision of the offer differs from these terms and conditions, the provision of the offer shall prevail, unless expressly stated otherwise.
2. Application and Conclusion of the Agreement
By submitting an application, the exhibitor expresses an interest in participating. Based on the application, the Organiser issues an offer or confirms the agreed terms of participation. The exhibition space is temporarily reserved until the expiry of the payment deadline specified in the offer. By paying the full amount specified in the offer, the exhibitor unconditionally accepts participation and the reservation becomes final. If payment is not made within eight days, or within another deadline specified in the offer, the temporary reservation shall expire without further notice. The exhibitor unconditionally confirms all data and applications entered by the exhibitor or their authorised representative through the exhibitor system, including exhibitor information, product names and details, names of staff and registered guests, and services ordered. The exhibitor is responsible for the accuracy, completeness and timely entry of such data, as well as for any costs and obligations arising from those entries. The exhibitor is responsible for safeguarding their login credentials and for all actions carried out through their user account. Any unauthorised use or suspected misuse must be reported to the Organiser immediately. Changes to data may be made until the deadlines published in the system, after which the Organiser does not guarantee their implementation in exhibition space signage, the catalogue, accreditations, tickets, voting or other materials. Notices sent to the email address specified in the application or published in the exhibitor system shall be deemed duly delivered. The exhibitor is required to regularly monitor notices and promptly report any change in contact details. The Organiser may reject an application, limit the number of registered products or propose a different exhibition space if necessary due to available space, safety considerations, the content concept or technical conditions of the fair.
3. Price and Payment
The price, included services, additional equipment, tax treatment and payment deadline are determined by the offer. Bank charges and all additionally ordered services shall be borne by the exhibitor, unless otherwise agreed in writing. The exhibitor is required to verify the invoicing details and promptly notify the Organiser of any changes. A delay in providing such information does not postpone the payment due date.
4. Cancellation and Replacement of Exhibitors
Once payment has been made, the application is final. If the exhibitor cancels, fails to attend or does not use the allocated space, they are not entitled to a refund of the amount paid, unless the Organiser agrees otherwise in writing. Transfer of the exhibition space to another legal or natural person is permitted only with the prior written approval of the Organiser. The Organiser may approve a replacement provided that all outstanding obligations have been settled and that the replacement exhibitor complies with the concept of the fair.
5. Allocation and Use of Exhibition Space
The Organiser determines the layout and final location of exhibition spaces. A published or previously presented layout may be changed for technical, safety or organisational reasons, while endeavouring to provide the exhibitor with a comparable position and the agreed scope of services. The exhibitor may use the space only for the registered products and activities. Subletting, sharing the space with an unregistered entity, unauthorised expansion beyond the allocated area and placement of equipment that obstructs aisles or neighbouring exhibitors are not permitted. The Organiser shall communicate the times for entry, setup, delivery, operation and dismantling by separate notice. The exhibitor is required to comply with these times and the instructions of fair staff.
6. Equipment, Safety and Products
The exhibitor is responsible for the proper functioning, safety, legality and labelling of products, equipment and promotional materials brought to the fair. The exhibitor must comply with fire safety, sanitary, hygiene, technical and other applicable regulations, as well as the instructions of the Organiser and venue operator. The exhibitor may use only technically sound equipment and connections corresponding to the power requirements declared in advance. The use of additional heaters, cooking appliances, refrigeration equipment, extension cables, high-power electrical devices, gas cylinders, open flames and other high-risk equipment is permitted only with the prior written approval of the Organiser. The exhibitor shall bear the cost of any damage or intervention resulting from undeclared, improperly connected or defective equipment. Weapons, explosives, highly flammable, toxic or other hazardous substances and objects may not be brought onto the premises. The Organiser may require the removal of any object or suspension of any activity that endangers persons, property, the programme, legal compliance or the reputation of the fair. The exhibitor shall bear all costs and responsibility for any required permits, copyright and other rights, protection of their products, equipment, money and personal belongings, and for the conduct of their employees, associates and guests.
7. Sales, Invoices and Fiscal Obligations
An exhibitor selling products at the fair is independently responsible for registering the appropriate business activity, meeting the requirements for occasional sales, registering a temporary business premises where required, issuing and fiscalising invoices, calculating taxes and excise duties, maintaining prescribed records and fulfilling all other legal obligations. The Organiser does not act as the seller of the exhibitor’s products and is not responsible for the exhibitor’s tax, customs, excise, fiscal or consumer obligations. The exhibitor shall independently handle customer complaints relating to their products, unless otherwise agreed in writing. Sales are permitted only for products and goods related to the subject matter and purpose of the fair. The Organiser may prohibit or suspend sales by an exhibitor who cannot demonstrate compliance with the prescribed requirements.
8. Food, Hygiene, Allergens and Tasting
An exhibitor who displays, prepares, offers for tasting or sells food is responsible for the safety of the products, registration and legality of food-related business activities, hygiene of staff and equipment, traceability, proper storage, maintenance of prescribed temperatures, expiry dates and prevention of cross-contamination. For food that is not pre-packaged, the exhibitor must ensure that clear and accurate information on the presence of substances or products causing allergies or intolerances, as well as all other mandatory information, is readily available before serving. If the information is provided orally, a notice stating that such information is available from staff must be displayed in a visible location, and the information must also be available in written or electronic form. Food preparation inside the hall is permitted only with the prior written approval of the Organiser and subject to compliance with all sanitary, hygiene, technical and safety requirements. The Organiser may restrict or prohibit the use of appliances, open flames, gas, processes that generate strong odours or other procedures that may endanger safety, ventilation, other exhibitors or visitors. The exhibitor is responsible for organising tastings, using appropriate utensils and tableware, maintaining the hygiene of the exhibition space and ensuring safe serving practices. Persons serving products must be familiar with their composition, allergens and the rules of responsible serving.
9. Accreditations and Guest Tickets
Two staff accreditations per day are provided for each exhibition space. Accreditations are collected at the entrance under the name of the exhibition space and may not be transferred to third parties. For each guest for whom the exhibitor wishes to provide a ticket, the exhibitor must enter the guest’s first and last name into the system in advance. The guest collects the ticket at the entrance under the first and last name entered in the system. After the fair, the exhibitor shall receive an invoice exclusively for tickets actually used, together with a list of recorded attendances. The exhibitor receives a 20% discount on the regular price of such tickets. Entering a guest into the system constitutes an instruction from the exhibitor to the Organiser to provide a ticket under the stated conditions.
10. Product Registration and People’s Choice
The exhibitor enters into the system the products that will be presented at the fair. As part of the People’s Choice selection, visitors may vote exclusively for products entered into the system within the deadline and in the manner determined by the Organiser. The exhibitor is responsible for the accuracy of the product name, category, producer and other product information. The Organiser may correct an obvious technical error, remove an inappropriate or inaccurate entry and establish voting rules to prevent misuse. The Organiser’s decision regarding the validity of votes and the final result is final.
11. Serving Alcohol and Responsible Conduct
Alcoholic beverages may not be offered or served to persons under the age of 18. If there is any doubt regarding a person’s age, the exhibitor must request identification or refuse service. The exhibitor and their staff are required to act responsibly and refuse further service to any person who refuses an age check or whose behaviour indicates excessive consumption, a threat to safety or disturbance of public order. The Organiser may remove any person who violates the rules of the fair. At the request of the Organiser or a competent authority, the exhibitor must provide evidence of the origin, lawful placing on the market and proper labelling of alcoholic beverages.
12. Cleaning, Waste and Restoration of the Space
During the fair, the exhibitor must keep the exhibition space tidy, properly sort and dispose of waste, and follow the instructions of the Organiser and venue operator. Waste, packaging and equipment must not obstruct aisles, emergency exits or neighbouring exhibition spaces. After the fair, the exhibitor must remove products, packaging, equipment and promotional materials and return the space in the condition in which it was received. The Organiser may charge the exhibitor for additional cleaning, disposal of items left behind, repair of damage and other justified costs. Items left by the exhibitor on the premises after the end of the fair may be removed or disposed of by the Organiser at the exhibitor’s expense.
13. Copyright, Music and Promotional Content
The exhibitor warrants that they have all necessary permissions for names, trademarks, logos, photographs, video content, packaging, promotional materials and other copyrighted or related rights used at the fair. The exhibitor is responsible for any third-party claims arising from the unauthorised use of such content. The public reproduction of music, video content or other copyrighted works at the exhibition space is not permitted without the prior written approval of the Organiser. If the Organiser permits such use, the exhibitor is responsible for any required registrations, rights and fees, unless the Organiser confirms in writing that it will assume responsibility for them. Promotional statements, health and nutrition claims and other information provided by the exhibitor to visitors must be accurate, verifiable and compliant with applicable regulations. Misleading statements and unauthorised comparisons with or disparagement of other exhibitors and products are not permitted.
14. Liability and Insurance
The exhibitor is liable for any damage caused by the exhibitor, their staff, contractors, equipment or products to the Organiser, venue operator, other exhibitors or third parties. Appropriate liability and property insurance is recommended. The Organiser may require an exhibitor who prepares food, uses higher-risk equipment, performs demonstrations or carries out other high-risk activities to provide proof of appropriate liability insurance. Failure to provide such proof may constitute grounds for prohibiting a particular activity or participation without entitlement to a refund. At the end of each fair day, the exhibitor is required to remove money, documents, electronic equipment and all other valuables from the hall. Products, equipment and other property left at the exhibition space remain there at the exhibitor’s own risk. The Organiser shall not be liable for theft, misappropriation, loss of or damage to the exhibitor’s products, equipment or other property, nor for interruptions in supply or other circumstances beyond its reasonable control, except where the Organiser’s liability arises under mandatory law or as a result of intent or gross negligence.
15. Foreign Exhibitors
A foreign exhibitor is independently responsible for customs, tax, excise, sanitary, import and other obligations related to bringing, displaying, tasting and selling products in the Republic of Croatia. The Organiser does not act as the exhibitor’s importer, customs representative, distributor or tax representative unless specifically agreed otherwise in writing. If these terms and conditions are available in multiple languages, the Croatian-language version shall prevail in the event of any discrepancy.
16. Changes, Postponement and Cancellation of the Fair
The Organiser may change the layout, timetable, programme, entrances, technical requirements or exhibitor arrangement if necessary for safety, implementation of the programme or circumstances beyond its reasonable control. Such changes, provided that they do not materially reduce the agreed service, shall not constitute grounds for a refund. If the fair cannot be held on the scheduled dates due to force majeure, a decision of a competent authority, security reasons, an epidemic, strike, infrastructure failure or another justified reason, the Organiser may set new dates. Any amount paid shall then be transferred to the new dates. If the Organiser ultimately cancels the fair without replacement dates, the exhibitor shall be refunded the fee for services not provided. The Organiser shall not be liable for the exhibitor’s travel, accommodation, production, marketing or other indirect costs, unless otherwise required by mandatory law.
17. Photography, Recording and Exhibitor Identification
Photography and video recording take place at the fair for the purposes of documenting, reporting on and promoting WineOS. The exhibitor is required to inform their staff and associates accordingly. For targeted recording of an individual, an interview or a promotional statement, the Organiser shall request appropriate consent where necessary. The exhibitor grants the Organiser a non-exclusive right to use the exhibitor’s name, logo and submitted product descriptions for the purposes of announcing, conducting and reporting on the fair. The exhibitor warrants that they have the necessary rights to the materials provided.
18. Personal Data
The Organiser processes the personal data of contact persons, accredited staff and guests for the purposes of processing applications, payments, issuing accreditations and tickets, security, communication and compliance with legal obligations. The exhibitor confirms that the persons whose data they enter into the system have been informed that their data will be provided to the Organiser. Data shall be retained for as long as necessary for the stated purposes and legal obligations. Questions and requests concerning the exercise of personal data rights may be submitted to the Organiser’s email address.
19. Supervision and Breach of Terms
The exhibitor is required to permit inspections by the Organiser, venue operator and competent authorities and, upon request, present permits, certificates, declarations, invoices, documents of origin and other evidence demonstrating the legality of products and activities. The Organiser may immediately suspend the sale, serving, demonstration or presentation of products that are not properly labelled, for which documentation is unavailable or where there is reasonable doubt regarding their safety, health compliance or legality. If the exhibitor breaches these terms and conditions, applicable regulations or instructions, the Organiser may issue a warning, require the irregularity to be remedied, suspend a particular activity or remove the exhibitor from the fair. In the event of a serious or repeated breach, the Organiser may close the exhibition space without entitlement to a refund, without prejudice to the right to claim compensation for any damage incurred.
20. Complaints and Dispute Resolution
Complaints must be submitted in writing to the Organiser’s address or by email to izlagaci@wineos.biz. The parties shall attempt to resolve any dispute by mutual agreement. The relationship between the Organiser and the exhibitor shall be governed by the laws of the Republic of Croatia. Any dispute that cannot be resolved amicably shall be subject to the jurisdiction of the competent court in Osijek, unless otherwise provided by mandatory law.
21. Final Provisions
If any provision of these terms and conditions is null and void or unenforceable, this shall not affect the validity of the remaining provisions. The Organiser may amend these terms and conditions where necessary due to regulations, safety or organisational requirements, and shall notify registered exhibitors of any material amendments. These terms and conditions apply from the date of publication and are valid for WineOS 12.
